State and Federal False Claims Acts impose liability on companies and persons who defraud governmental programs, and FCA cases may be prosecuted by individuals or the government. Claims under the FCA have involved a broad range of government programs, including health care and the military. The panel will give an overview of the statute and its increasing role as a powerful means of holding accountable those who have defrauded the government. The panel will also discuss the FCA state counterparts, and the SEC, CFTC and IRS programs. No longer largely confined to healthcare/DOD fraud, the False Claims Act is a major tool in uncovering and combating large financial frauds.
