On October 26, 2018, Jonathan Lim spoke at the 10th Annual AIJA International Arbitration Conference in Singapore on a panel titled “Taking Stock of International Arbitration in the Age of Transparency.”
Mr. Lim gave a presentation on recent developments in transparency in investment arbitration, including the UNCITRAL Rules on Transparency and the Mauritius Convention, and explored the extent to which these developments should also affect commercial arbitration. The panel, which also comprised industry leaders and practitioners from Schellenberg Wittmer, FTI Consulting and Drew & Napier, discussed other aspects of transparency, including the transparency of arbitral institution decision-making, amicus curiae submissions, the publication of awards and whether the presumption of confidentiality in jurisdictions such as England and Singapore should be maintained.
