The European Commission recently published a package of important documents on Intellectual Property, including 'Communications' that give guidance on the EU IP Enforcement Directive and on FRAND-encumbered Standard Essential Patents (SEPs). The documents are as significant for what they do not say as for what they do.
On January 18, WilmerHale will host a webinar discussing the latest position in Europe on the availability of injunctions and on the approach to SEPs, and the effect of the Commission's IP package.
WilmerHale London Partners Matthew Shade and Anthony Trenton and Frankfurt Partner Vanessa Wettner will discuss:
- the EU IP Enforcement Directive as it relates to injunctions, its interpretation by the CJEU and the impact of the Commission's guidance;
- the courts' approaches to injunctions in Germany and the UK, including the exercise of discretion;
- the German and UK courts' approaches to SEPs following Huawei v. ZTE and subsequent developments; and
- the EU Commission's guidance on SEPs.
