This is the first in a series of client alerts addressing the likely role of the False Claims Act (FCA) in the wake of the massive federal government response to the COVID-19 pandemic. It provides some historical context for the FCA, and looks back to the financial crisis of 2008-2009, and the federal government relief programs that were enacted at the time, to understand how the FCA may be applied in the wake of the passage of the CARES Act.
