Experience

    • Representing a multinational technology company in a grand jury investigation in the Eastern District of Texas related to visa practices.
    • Representing a financial institution in responding to a civil investigative demand from the State Department and DHS regarding alleged noncompliance with visa regulations.
    • Advising a manufacturing company on a DHS and DOJ investigation regarding visa and labor practice issues.
    • Representing Tata Consultancy Services in litigation alleging underpayment of visa fees and retaliation in violation of the False Claims Act [see Palmer v. Tata Consultancy Services (ED Tex.), Kini v. Tata Consultancy Services (DDC, currently on appeal to the DC Circuit)].
    • Successfully obtaining dismissal of a False Claims Act case for a major technology company in litigation in the Northern District of California alleging violations related to visas obtained for foreign nationals to perform high-tech work in the US.
    • Representing a technology company in its landmark November 2023 settlement with DOJ’s IER Section to resolve allegations that Apple discriminated against US citizens during recruitment for positions falling under the permanent labor certification program (PERM).
    • Currently representing several companies in similar ongoing IER investigations of their PERM programs (many cases focus on the tech industry, but other industries that hire foreign talent are potential targets, including financial services, life sciences, healthcare, engineering and other fields where there is a significant demand for foreign workers with specialized skills requiring advanced degrees).
