On 14 June 2019, the International Arbitration Group at Wilmer Cutler Pickering Hale and Dorr LLP conducted a seminar in Mumbai on “Effectively Navigating the Arbitral Process – A Practical Approach for In-House Counsel.”

The exclusive event for in-house counsel was held in collaboration with the Disputes practice of AZB & Partners (“AZB”) and touched on key issues in international arbitration in India and elsewhere. The event was structured across four interactive sessions:

  • Pre-dispute considerations, including the selection of an appropriate seat and institutional rules and effectively structuring transactions across multiple contracts and parties
  • Kick-starting the dispute, including maximizing investment treaty protections, third-party funding and emergency arbitration
  • Time and cost savings during the proceedings, including the use of bifurcation, early dismissal mechanisms and expedited procedures and resourcefully gathering evidence and managing the document production phase
  • Enforcement of awards, including issues relating to the enforcement of awards under the New York Convention and domestic and cross-border tools to trace and attach assets

The sessions saw a stimulating exchange of views between members of the panel, which included Partners Gary Born and Steven Finizio, and AZB Partners Zia Mody, Rajendra Barot and Anoj Menon. The discussions were moderated by Senior Associate Dharshini Prasad and AZB Partner Sonali Mathur.
