In early 2009, the Department of Homeland Security announced that US Immigration and Customs Enforcement (ICE) would focus on the criminal prosecution of employers who knowingly hire illegal workers in order to target the root cause of illegal immigration.
ICE also increased its I-9 audits as part of its focus on holding employers accountable for their hiring practices and efforts to ensure a legal workforce. In July 2009, it issued 652 Notices of Inspection (NOIs) on businesses, and another 180 businesses were served NOIs in March 2010.
Additionally, ICE has increased the use of administrative fines against employers of illegal aliens. In November 2009, 61 notices of intent to fine were issued to employers by ICE, resulting in approximately $2.3 million in fines, and an additional 267 cases were still being considered for notice of inspection.
