Storming the Gatekeepers: When Compliance Officers and In-House Lawyers are at Risk 2020

  • 9.2.2020 | 9:00 AM - 5:00 PM

In 2020 the federal government approved historic levels of funding with The CARES Act while local governments implemented emergency relief to allay unemployment, health care, and housing concerns during the COVID-19 pandemic. Inevitably increased funding and regulations will result in expanded government oversight of organizations and thus greater risk of liability for the in-house attorneys and company compliance officers—the “Gatekeepers”—tasked with ensuring organizational compliance.

This program is designed for both gatekeepers and lawyers who represent them and will feature experienced in-house and outside counsel, chief compliance officers and government officials who will use hypotheticals to discuss a variety of topics concerning the responsibilities and conduct of gatekeepers and provide practical advice dealing with the government’s increased policing of the activities of gatekeepers.

What You Will Learn:

  • The inherent risks and responsibilities of gatekeepers
  • How the CARES Act and COVID-19 related regulations might impact the role of gatekeeper
  • Limitations exist on privilege in the compliance area
  • How to defend a gatekeeper under investigation
  • Hear about how the government thinks of the gatekeeper role
  • Preparing for investigations of gatekeepers

WilmerHale Partner Ronald Machen will speak on the panel "The Government's View: When Watching the Gate is Not Enough."
