This conference will focus on “Patent and Ambiguity: Navigating Today’s Reality” and discuss the uncertainty over the future of patent protection: will our portfolios, which we spend so much to build, be worth a fraction of their values tomorrow? In light of this uncertainty, companies can lay low or proactively navigate the ambiguity that is the new reality and learn more throughout this two-day conference.
WilmerHale Partner Mark Selwyn will speak on the "Evolution of Damages Law and the Status of RAND: Are We Finally Seeing Clarity?" panel. In the past year, there has been a litany of district and federal circuit cases in which the court has provided increasing clarity on methods for calculating damages as well as reasonable and non-discriminatory licensing rates. The Courts appear to be shifting towards more reasonable damages awards, causing settlement and licensing fees to decrease. This panel will discuss the impact of recent Court opinions on their licensing and settlement negotiations.
