Michael E. Kaplan
Counsel
Michael Kaplan counsels clients on a wide range of complex real estate projects and transactions, including acquisitions, dispositions, financings, joint ventures and leasing matters. His clients include domestic and international real estate investment trusts (REITs), private investors and developers, with a broad spectrum of asset classes, including life sciences, industrial, office, hospitality, student housing and senior housing. Mr. Kaplan leverages over a decade of experience handling large, sophisticated real estate transactions to help clients achieve their business goals in an effective and efficient manner. As a member of WilmerHale’s Transactional Department, he regularly collaborates with colleagues in the firm’s Tax, Corporate, Environmental, Bankruptcy, Life Sciences and Labor and Employment practices.
Prior to joining WilmerHale, Mr. Kaplan was a senior associate at another large law firm in Denver, CO and Washington DC. While there, he managed real estate clients and matters, negotiated and drafted definitive documents and supervised deal teams. He also led real estate aspects of corporate transactions, including public and private acquisitions, dispositions and spin-offs.
Mr. Kaplan also maintains an active pro bono practice in the areas of immigration and real estate.
Professional Activities
Mr. Kaplan serves on the board of the Anti-Defamation League, Mountain States Region and was previously a member of the Downtown Denver Partnership Leadership Program. He was appointed to Law360’s Real Estate Editorial Advisory Board for 2024.
He is a participant in the ACG Denver Leadership 20 Class for 2023-2024.

Selected matters at WilmerHale:
- Represented a senior housing developer in its negotiation of a $300M programmatic equity investment from an institutional equity investor.
- Represented a public REIT in its sale of roughly $700M of life sciences buildings across the United States.
- Represent a privately held company in connection with the negotiation of an amendment to a lease in Midtown New York pursuant to which the client leased an additional 126,851 SF.
- Represent various life sciences clients in their tenant-side leases across the United States.

Prior to joining WilmerHale:
- Managed the real estate portion of the spin-off of an information technology infrastructure services company from a Fortune 50 company, which included over 400 sites in 35 countries.
- Represented a Canadian institutional investor in the $1B portfolio acquisition and subsequent $600M financing of approximately 160 industrial properties in 18 jurisdictions across the United States.
- Represented a public Singaporean client in numerous real estate acquisitions, including:
- $750M 14-property data center portfolio in 10 jurisdictions across the United States;
- $1.4B 13-property data center portfolio in 8 jurisdictions across the United States and Canada;
- $198M student housing facility, including the negotiation of an assignment of ground lease and amendment to ground lease with a university ground lessor; and
- $259M office building.
- Represented a public hotel REIT in various transactions, including:
- Managing the real estate portion of its spin-off from a public hotel brand; and
- Managing real estate diligence and brand negotiations in connection with the acquisition of a public REIT.
