Leveraging his experience as a member of the SEC Enforcement Division’s Asset Management Unit and Crypto Assets and Cyber Unit, David Tutor brings a wealth of knowledge and expertise to representing clients in complex securities enforcement and litigation matters involving the SEC and other government agencies. At the SEC, Mr. Tutor investigated and charged a wide range of cases involving investment advisers, broker-dealers, mutual funds, private funds, separately managed accounts, and public companies. Mr. Tutor also served as Counsel to the SEC’s New York Regional Director and Counsel to the Co-Directors of the Division of Enforcement. In 2022, Mr. Tutor received the Stanley Sporkin Award, one of the SEC’s top awards for its enforcement officials.

Mr. Tutor led some of the SEC’s most high-profile investigations, including charging an investment adviser in connection with a more than $1 billion overvaluation scheme. Mr. Tutor’s other significant AMU matters included charging an investment adviser for breaching its fiduciary duty and violating the Marketing Rule, as well as for compliance failures related to its ESG disclosures, charging a mutual fund for mispricing its NAV, and charging an investment adviser with repeated Custody Rule and policies and procedures violations. Mr. Tutor’s notable crypto matters included charging an entity for operating an unregistered centralized digital asset exchange and charging fraud, illegal touting, and market manipulation in connection with multiple crypto offerings. 

Mr. Tutor joined WilmerHale after spending seven years as an attorney in the SEC’s Division of Enforcement based in its New York Regional Office. Mr. Tutor previously clerked for the Honorable Barbara S. Jones of the US District Court for the Southern District of New York.
