Excerpt: “Regardless of the areas that individual Democratic attorneys general choose to pursue, they are likely to partner with fellow attorneys general through a coordinated multistate litigation strategy, thus allowing them to select friendly district court venues when seeking injunctive relief on an emergency basis. While this is now a well-worn tactic, multistate litigation offers the attorneys general the ability to take a coordinated approach and share resources, which will be important considering the Democrats face a unified Republican-controlled Congress and White House, and a US Supreme Court leery of the administrative state.”
