The 2022 White Collar Crime National Institute marks its 37th year on March 2-4, 2022. The institute will feature outstanding panelists who deal with some of the most significant issues of our time.
The full program will include a number of “skills” and “ethics” sessions to satisfy the CLE requirements of all state bars. The institute has scheduled panels that will address the continuing challenges created by the pandemic during investigations, trial preparation, conduct of trials and sentencing. The panel of distinguished judges and a separate panel of trial lawyers will address their approaches to many of these logistical and procedural issues.
On Wednesday, March 2, 2022, WilmerHale Partner Michael Leotta will moderate the panel "Ethical Issues in Internal Investigations." Panelists will address ethical issues that arise when conducting internal investigations and cooperating with government inquiries, including special considerations when an organization is the client, when to use informal conversations versus formal Upjohn interviews for fact-gathering, factors to weigh when deciding whether to obtain independent counsel for individuals, and the special responsibilities of a prosecutor.
On Thursday, March 3, 2022, WilmerHale Partner Christopher Cestaro will participate as a speaker on the panel “The New DOJ Corporate Guidelines – Practical Application and Impact.” Panelists will examine the latest prosecution guidance from DOJ and its practical implication for companies and practitioners, and consider its perspective on corporate recidivism, cooperation credit, imposition of monitors, and consequences of breaches of existing resolution agreements.
