The year 2022 was a historic year for the Commodity Futures Trading Commission (“CFTC” or the “Commission”). The past year saw new developments in digital asset markets, and in the event contract and retail commodity/precious metals spaces. Record-breaking penalties and fines were issued from an aggressive enforcement effort, with novel theories established in cases that addressed issues of first impression. This alert reviews the CFTC’s enforcement and regulatory developments in 2022 as well as looking forward to 2023 for what may be in store.
